SOUL/PARTY PLANE TO PARADISE
OFFICIAL CONTEST RULES
CONTEST DESCRIPTION:
The Soul/Party Plane to Paradise contest (“Contest”) will begin on October 24, 2011 and end on November 18, 2011 (“Contest Period”). Twelve (12) Grand Prize Winners will each be awarded a three (3) night/four (4) day trip for two (2) adults to The Bahamas, valid for Friday, December 16, 2011 – Monday, December 19, 2011. Trip includes: a. Round trip coach class air transportation for two (2) adults from Richmond International Airport to Grand Bahama Island, Bahamas; and b. Double occupancy hotel accommodations (one (1) room) for a three (3) night stay at the Grand Lucayan Resort.
HOW TO ENTER:
Listeners of WCDX-FM and WKJS-FM who are legal residents of the U.S. residing within the terrestrial listening area of the stations, and are 21 years of age and older will be able to take part in this Contest. There are two methods of Contest entry for listeners of both stations. To participate in the Contest, listeners must do the following:
1.Listeners of WKJS will be asked to listen weekdays (Monday – Friday) during the Contest Period for the Party Plane to Paradise song of the day. Upon hearing the song of the day, contest participants must text the word “partyplane” to 80185. Standard text and data rates will apply.
2.Listeners of WDCX will be asked to listen for two (2) songs played back to back from the IPower Soul Plane to Paradise artist of the day. Upon hearing the songs from the artist of the day, contest participants must text “soulplane” to 23092. Standard text and data rates will apply.
3.Listeners also have the chance to participate in the Contest by registering online through the stations’ websites at www.kissrichmond.com or www.ipowerrichmond.com during the Contest Period, and must provide a brief explanation as to why they deserve a flyaway.
4.Upon entering the Contest website, participants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, brief explanation, and any optional or additional contact information, as requested, to register for a chance to win.
5.Statements submitted by online entrants will not be judged and will have no bearing on determining the winner, except that online entries that do not contain the requested explanation will be disqualified.
6.In the event of a dispute regarding the identity of a participant’s entry, the entry will be deemed to have been made by the authorized holder of the e-mail / mobile account at the time the entry was made.
7.A total of six (6) trips will be given away on WCDX and six (6) trips will be given away on WKJS.
ELIGIBILITY RESTRICTIONS:
1.The Contest is open to listeners of WCDX-FM and WKJS-FM who are 21 years of age and older and are legal residents of the U.S. residing within the terrestrial listening area of the stations.
2.Employees of WCDX-FM, WKJS-FM, Radio One, Inc. (“Radio One”) its subsidiaries, affiliates, general sponsors, advertisers, promotional partners, other radio stations in the Richmond, VA metropolitan area, and members of their immediate families or those living in the same households (whether related or not) of any of the above are NOT eligible to participate or win in this Contest. For purposes of this Contest, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.
3.Contest participants are not eligible to win more than one qualifying prize during this Contest. Entrants are not eligible to win more than one grand prize trip during this Contest.
4.Winner and guest must each possess a valid passport along with a valid driver’s license (or other government issued photo I.D.) prior to departure and must travel together on the same itinerary. Travel guest of the grand prize winner, must also be twenty-one (21) years of age or older and a legal resident of the U.S. Travel guest will be required to sign and submit all requested release forms along with the grand prize winner.
5.Persons who have won a prize in another contest or promotion of any kind from WCDX and WKJS within the thirty-day (30) period immediately preceding the start date of this Contest are not eligible to participate. Only one person per family or household (whether related or not) may win in any promotion from WCDX and WKJS during any thirty (30) day period.
PRIZES:
A.Qualifying on-air prizes will include the following:
a.Station Prize packs (consisting of available station merchandise); station bags.
b.CDs, DVDs, gift cards, event-tickets, or T-shirts
B.Grand Prize package will include the following:
A three (3) night/four (4) day trip for two (2) adults to The Bahamas, valid for Friday, December 16, 2011 – Monday, December 19, 2011. Trip includes: (i) Round trip coach air transportation for two (2) adults from Richmond International Airport to Grand Bahama Island, Bahamas, and (ii) Double occupancy hotel accommodations (one (1) standard room) for a three (3) night stay at the Grand Lucayan Resort.
a.The Bahamas Ministry of Tourism and Aviation, Vision Airlines, and Grand Lucayan Resort (collectively, the “Sponsors”) are not responsible for lost or stolen prize certificates/redemption letters and the prize is not redeemable without the original prize certificates/ redemption letters.
b.Grand Prize Winner must complete the trip on the dates provided or prize will be forfeited. No extension will be given after the dates for the Grand Prize trip have expired and prize will be forfeited and Sponsors shall have no further obligation to Grand Prize Winner.
c.Grand Prize Winner and guest must travel together on the same itinerary and are responsible for obtaining all required travel documents (i.e. valid passport).
d.Travel arrangements will be booked through Sponsors for the dates provided and cannot be changed in any way once booked and confirmed. Certain travel restrictions may apply.
e.Grand Prize Winner and guest will be responsible for any other costs and expenses associated with acceptance and use of the prize. Ground transportation, meals, beverages, activities, inter-island transportation, tours, gift shop purchases, telephone calls, gratuities, souvenirs, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes and other expenses are the responsibility of the winner and his or her guest.
f.All prize details will be at the sole discretion of the Sponsor. All prizes are awarded “as is” with no warranty or guarantee, either express or implied.
g.No substitution, transfer, or cash equivalent of prize is permitted, except by Sponsors, which reserve the right to substitute a prize of comparable or greater value, at their sole discretion.
h.Any and all taxes on the prize, and any other costs, fees, and expenses not explicitly stated herein as being awarded, are the sole responsibility of the prize recipient.
i.No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by WCDX and WKJS management and/or the Sponsors in their sole discretion.
j.All contest winners must sign and date official WCDX and WKJS release and waiver forms as requested. Failure to do so will result in winner forfeiting the prize.
k.If for any reason a contest winner decides not to accept an awarded prize, the winner will be required to sign a release form acknowledging forfeiture of the prize. It will be at the discretion of the contest sponsor and / or contest administrator if another contestant is to be selected as the winner if time permits.
l.If contest winner does not claim their prize within 24 hours of winning notification, they forfeit the prize.
m.Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.
EXECUTION:
1.During the Contest Period, eligible listeners will be encouraged to participate in the Contest via one of two methods of entry: by submitting a text message, or registering online for a chance to win.
2.To participate via text message; WKJS listeners must text the word “partyplane” to 80185. WCDX listeners must text the word “soulplane” to 23092. Standard text and data rates will apply.
3.To participate online, contestants must register and submit a brief explanation as to why they deserve a flyaway through the WKJS website at www.kissrichmond.com, or the WCDX website at www.ipowerrichmond.com.
4.Three (3) contestants will be selected each week day (Monday through Friday on each station) to win a qualifying prize pack. The qualifiers will be selected by random drawing from among all eligible entries received via text message.
5.Five (5) grand prize winners will be selected by random drawing from among all eligible contestants that qualified by winning a prize pack on WCDX during the Contest Period.
6.Five (5) grand prize winners will be selected by random drawing from among all eligible contestants that qualified by winning a prize pack on WKJS during the Contest Period.
7.At the end of the Contest Period, one (1) grand prize winner will be selected by random drawing from among all eligible entries received through online registration on the WCDX website.
8.At the end of the Contest Period, one (1) grand prize winner will be selected by random drawing from among all eligible entries received through online registration on the WKJS website.
9.Winners will be notified by phone and provided with instructions for claiming their prize.
10.All decisions made by WCDX, WKJS, and Radio One management regarding any aspect of this Contest are final.
GENERAL CONDITIONS:
1.Winners are responsible for all applicable taxes associated with the receipt of the prize (prizes are not transferable and may not be exchanged).
2.Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.
3.No purchase necessary. Contest is void where prohibited. Contest is subject to all applicable federal, state and local laws and regulations.
4.Odds of winning depend upon the number of eligible contestants participating during the Contest Period.
5.By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize. By entering this contest, each participant agrees to comply with the Official Rules and the decisions of the contest sponsor which shall be final and binding in all aspects relating to the contest.
6.Dates and times of concerts, events, and trips promoted by Contest sponsors are subject to change and those changes are deemed to be beyond the control of WCDX, WKJS, and Radio One. Changes of venue, cancellation of engagements by performing artists, and/or their management may be permanent in nature. WCDX, WKJS, and Radio One are not obligated to make any effort to find an alternative prize under these circumstances.
7.All contest winners will be required to sign a liability release prior to acceptance of any prize. Pursuant to the liability release, the winner or winners will agree to hold WCDX, WKJS, Radio One, any other contest parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with contest participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.
8.Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.
9.WCDX and WKJS retain the right to disqualify any contestant if all contest rules are not followed. Contest void if prohibited by law.
10.So long as no participant is materially adversely affected, WCDX and WKJS reserve the right to make changes in the contest rules, which will become effective upon being announced on the air and / or posted online.
11.WCDX, WKJS, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any contestant to complete or continue a telephone call, facsimile transmission or internet registration due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries. In addition, WCDX, WKJS, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete contest entries. Once submitted, entries become the property of WCDX and WKJS and will not be returned.
12.By accepting the prize, the winner acknowledges that WCDX, WKJS, and Radio One, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
13.WCDX, WKJS, Radio One, its subsidiaries, its affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the contest, including; cancellation of the contest as a result of the occurrence of events not within the control of WCDX, WKJS, Radio One, its subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties. In the event, such an act should occur; reasonable attempts will be made to offer the winner comparable prize(s) currently being offered by WCDX and WKJS in lieu of the prize originally awarded.
14.If for any reason, the Contest is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the Contest is compromised by virus, bugs, worms or unauthorized human intervention, fraud, an insufficient number of qualified Contest entries, or any other causes beyond WCDX, WKJS, and Radio One’s control which, in WCDX, WKJS, and Radio One’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Contest, WCDX, WKJS, and Radio One reserve the right to cancel, terminate, modify or suspend the Contest at their sole discretion.
15.Copies of contest rules are available upon request during regular business hours, Monday – Friday 9:00 a.m. to 5:00 p.m., in the offices of WCDX and WKJS, located at 2309 Emerywood Parkway Richmond, VA 23294. Copies of contest rules may also be made available online at www.kissrichmond.com, and www.ipowerrichmond.com.
